AL-MALABAD: Imran Khan, the former prime minister and chairman of the Pakistan Tehreek-e-Insaf (PTI), was placed under house arrest on Thursday, and the Election Commission of Pakistan (ECP) issued production orders against him for disobedience. When the Chairman PTI is present on October 24, a charge sheet will submitted against him.
Imran Khan and Fawad Chaudhary, a former PTI member, given two different. But nearly identical orders by a four-member bench led by ECP member Sindh Nisar Ahmad Durrani.
On October 24, both will face charges. But in Fawad Chaudhary’s instance, the panel also issued arrest warrants with the possibility of bail. And gave the appropriate IGP instructions on how to execute them.
Shoaib Shaheen, who had appeared before a four-member commission panel led by Nisar Durrani, argued at the hearing on October 11 that the PTI chairman could not attend since he was in jail. He had pushed for the PTI chairman’s production order.
The order made public states that it a matter of record that the case had pending resolution since August and needed to resolved right away. Given that the respondent is incarcerate at Adiala Jail. It is necessary for him to personally appear in order to continue with the case. Given this perspective, the only option is to issue a production order for the respondent, Imran Ahmed Khan Niazi, according to the order.
According to the commission, the production order is issue in accordance with Section 10 of the Elections Act of 2017. Rule 4 of the Elections Rules of 2017, and the pertinent section of the Contempt of Court Ordinance, 2003. The respondent will only produced in front of the Election Commission of Pakistan on October 24, 2023, at 10 a.m. And will immediately returned to custody following the conclusion of the proceedings.
The commission’s bench issued an order instructing the office to inform the superintendent of Adiala Jail in Rawalpindi of the need to make all required preparations for the respondent’s production before ECP. We have requested that the IGPs of Punjab and Islamabad make sure that all necessary security measures are in place for Imran’s production.
Similarly, the same four-member bench ordered serving bailable arrest warrants on former leader of (PTI) Fawad Ahmad Chaudhry for using “intemperate, unparliamentary language and contemptuous remarks” against the Election Commission as well as the Chief Election Commissioner Sikandar Sultan Raja.
It further said, “The previous order dated 22.08.2023 to complied with by respondent. But he is not in attendance despite direction for personal appearance. Qamar lnayat, Advocate, appeared on behalf of Faisal Fareed Ch, Senior Counsel for respondent. He states that the respondent is unwell due to which he is unable to appear before the Commission and Faisal Fareed has to appear before the Honourable High Court.
“He made a request for adjournment. lt reveals from previous order sheets that the respondent is seeking adjournments on one or the other pretex. And is reluctant to appear voluntarily. ln such view of the matter, we have left with no alternative except to issue a bailable warrant of respondent. Consequently, a bailable warrant of arrest against the respondent (Fawad) is issued in the sum of Rs50,000/- with two sureties in the like amount each,” the orders read.
According to the orders, the bailable warrant shall executed through the Inspector General of Police, Islamabad. Who shall ensure compliance strictly in accordance with law. The office is to take follow-up action and list the matter on October 24 at 10 am for framing of charge against the respondent.
